Terms of Service

These Terms of Service ("Terms") govern access to and use of Bogas Training: the coach console, the client app, the public pages served for a coach, and the integrations for WhatsApp, Instagram, Facebook Messenger, Google Calendar, Stripe and Plaid, all provided by Bogas Solutions LLC ("Bogas", "we", "us"). By using the service you agree to these Terms.

1. Who we are

Bogas Solutions LLC is a software company based in Puerto Rico (United States). Product site: bogastraining.com. Company site: bogassolutions.com. Contact: info@bogassolutions.com.

2. The service

Bogas Training gives a coach a workspace to capture and answer leads, book calls, deliver training and nutrition programs, collect payments and reconcile them, and to connect the coach's own accounts (messaging accounts on WhatsApp, Instagram and Facebook Messenger, Google Calendar, Stripe and a bank connection through Plaid). For messaging, Bogas acts as a technology provider that helps the coach receive and reply to messages from the coach's own customers. Bogas does not provide coaching, medical or nutritional advice; the coach does.

3. Accounts and eligibility

• The service is intended for businesses and users who are at least 18 years old.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You must have the authority to connect any account you connect (messaging, calendar, payments or bank) and to authorize the processing described in our Privacy Policy.
• A coach is responsible for the people they add to their workspace and for their clients' use of the client app.

4. Acceptable use

You agree not to use the service to:

• Send spam, unsolicited bulk messages, or content that breaks the rules of WhatsApp, Instagram, Messenger or any other connected platform.
• Message people who have not agreed to hear from you, or keep messaging someone who asked you to stop.
• Break any applicable law, infringe others' rights, or try to access data that is not yours.
• Interfere with, probe or disrupt the integrity or performance of the service.

When you use the messaging integrations you also agree to comply with the WhatsApp Business Terms, the WhatsApp Business Messaging Policy and the Meta Platform Terms as they apply to businesses. We may suspend access that puts our platform or a connected account at risk.

5. Customer data and ownership

Business and messaging data a coach records or receives through the service belongs to that coach. We process it on the coach's behalf to operate the service, as described in the Privacy Policy. We do not sell it or use it for advertising. Each workspace is isolated from every other workspace.

6. Third-party services

The service integrates with third parties such as Meta Platforms, Google, Stripe, Plaid and Anthropic. Your use of those integrations is also subject to the respective provider's terms, and we are not responsible for their services, their availability or changes they make.

7. Fees

Fees are set out in the order or agreement between Bogas and the coach. Charges billed by a third party the coach connects (for example, WhatsApp conversation charges billed by Meta or Stripe processing fees) are the coach's responsibility.

8. Disclaimers and liability

The service is provided "as is" without warranties of any kind to the extent permitted by law. Bogas is not responsible for the content of a coach's programs, plans or messages. To the maximum extent permitted by law, Bogas is not liable for indirect, incidental or consequential damages, and our total liability is limited to the amounts paid for the service in the twelve months before the claim.

9. Termination

Either party may terminate as set out in the applicable agreement. A coach may ask to close their account at any time. On termination, access ends and data is handled as described in the Privacy Policy and our Data Deletion Instructions.

10. Changes

We may update these Terms from time to time. The current version is always published at this address with its revision date. Continued use after an update means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and the applicable laws of the United States, without regard to conflict-of-law rules.
